I know as well as you do that certain clients will never do this, at least, not with the necessary consistency. However, we’re continually refining this service to make it as easy and rewarding as possible for the average client to use:

  1. conditional survey logic (so clients only have to answer questions pertinent to their symptoms);
  2. automatic text message reminders when the survey isn’t completed;
  3. in-app messages explaining the importance of this information for their claim.

Most clients welcome this opportunity to “have the judge spend a day with me” and create a record of symptoms that are otherwise invisible.

Symptom tracking is recognized as a clinically valid method for documenting variable and/or subjective symptoms over time.

You can further strengthen the evidence ClaimData creates by requesting that your client’s providers attest to the clinical validity of patient self-report data.

In light of all the information the survey records, it’s extremely unlikely that simply using ClaimData will show that a sick or injured client is capable of full-time computer work.

The survey records the following information every day:

  1. how long the client spends doing the survey;
  2. what kind of device they use;
  3. their posture while doing it (walking, sitting upright, reclining, lying down);
  4. any symptoms that made completing the survey difficult;
  5. the specific degree of difficulty they experienced (if any difficulty was reported).

Most clients do the survey on their phone in 10 to 15 minutes while reclining or lying down. And since the software records the precise way that the client uses it along with any difficulties they experience, the client’s use of ClaimData provides further documentation of their impairments.

In addition, when submitting their daily responses, ClaimData requires your client to swear or affirm that they truthfully answered the questions to the best of their ability. In effect, ClaimData permits your clients to testify every day about their conditions as they actually occur.

ClaimData is designed to provide you with actual contemporaneous evidence of clients’ symptoms and functioning. For that reason, clients can only provide answers for a given day on that day between 6:00 p.m. and 11:59 p.m. (the software adjusts for their particular time zone).

The client will receive 2 text message reminders asking them to complete the survey. If they start the survey but they’re unable to complete it, they’ll be asked to explain why. If they don’t start the survey at all, on the morning of the following day they’ll receive a single question asking them to explain why they didn’t do the survey the day before. In this way, their non-compliance can further demonstrate their degree of limitation.

Your client’s privacy is our first priority. Your clients’ data is securely stored on Amazon Web Services (AWS) servers located in the U.S. using security and networking best practices and protected by redundant and layered access controls, continuous validation and testing, and automation to ensure that the underlying infrastructure is monitored and protected 24×7. But back to HIPAA: ClaimData is neither a healthcare provider, nor an organization “that furnishes, bills, or is paid for healthcare,” nor a “health care clearinghouse.” Neither is it designed to diagnose or treat any health condition. As such, it is not a covered entity under HIPAA.

Instead, ClaimData is an attorney-designed platform for capturing and reporting confidential attorney-client communications regarding the functional limitations resulting from clients’ medical conditions.
